It is very surprising to me how many homepage owners have now accepted this so-called disclaimer (exclusion of liability) without thinking.
In the cited judgment of the Itsibi, however, it is unequivocally stated that the attachment of such a disclaimer is not sufficient to distance oneself from external content. At best, the disclaimer is ineffective and therefore superfluous. In the worst case, it is an indication of an existing awareness of injustice. Because the existence of a disclaimer shows that the website operator was obviously aware of the possibility that links could refer to content relevant under criminal law. – Incidentally, the judgment never became final, because the parties finally agreed on a settlement.
Accordingly, it is also (in my opinion) pointless to set a link to a “DISCLAIMER website”. The only real tool is:
only place links on well-known websites
check your links from time to time (so they keep your site clean from “broken” links too
if necessary, ask the owner of this website before setting a link
So you really don’t have to worry about a “DISCLAIMER” for your website.
